Title 42 suspends all title 8 laws and authority use to deter and penalize illegal border crossing. The Right is using it to undermine legal asylum under 8 US code 1158. It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border illegally. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing and stops legal asylum, with few exceptions under title 42. Makes it difficult to enforce immigration laws when Republicans are fighting in court to undermine our legal enforcement. With title 42 suspending enforcement that means many immigrants recross multiple times causing apprehension numbers to be inflated. The current rate of multiple returns is about 40% of border crossers. We had a 17 year decline in southern border crossing to the lowest point in 50 years prior to Trump and his polices. By 2019 Trumps policies doubled the number of people crossing the southern border to 977,000 a 20 year high. He only saw a reduction for the first 9 months of 2020 due to covid, before it went back to a 20 year monthly high in October of 2020. It has remained a 20 year high and increasing ever since under Trumps failed policies and Title 42....

@mikewurlitzer5217 No remain in Mexico was not working as southern border crossings increased after it was implemented. Remain in Mexico violates US immigration law, 8 USC 1158 and 8 USC 1225. It was being used on asylum seekers who used a port of entry. And forced those who passed creditable fear interview to remain in Mexico when they are to remain in the US, by our laws. It is the reason for the increase of border crossings between check points and the number of unaccompanied minors crossing the border. If you think you can explain border law and policy in 5 words, then you don't have a clue what you are talking about. Context is not the friend of the Right. Remain in Mexico has nothing to do with title 42, they are separate policies.

What the Right calls an open border policy is our asylum law 8 USC 1158. It is a 40 year old law that the Right does not support and they claim is a loophole in the law. The Right is doing everything they can to undermine that law. In the process of undermining that law the Right has created an open border, with title 42. title 42 makes it almost impossible to enforce our title 8 immigration laws that deter illegal border crossings.

@paulaharvey1171 Yes, but they are free to just cross again without penalty and it is overwhelming resources.
1
@paulaharvey1171 Title 42 goes away next month so at that point Republicans will have ran out of polices that are undermining our enforcement of our immigration laws. The election will change nothing.

@kathyheavner3585 what am I uninformed about? Go ahead and lie to me and act as if you know anything about the law or have bothered to read it. Let's hear what you have to offer when you do nothing but listen to Right wing talking points and rhetoric and except them as fact without any evidence or attempt to confirm Right wing claims. Show one peice of evidence thst disproves my statement.
1
@kathyheavner3585 Don't ever watch it. I watch Right wing media and spend my time debunking it with context and acctual facts. keep your head up your ars, you seem good at it.

@cwg9238 the right keeps feeding you that stupid talking point. Your house does not have asylum laws or treaty obligations either. It's not my logic, it's' been law for over 50 years. Why is the Right so completely cluless of common knowlegde?

@cwg9238 §1158. Asylum (a) Authority to apply for asylum (1) In general Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien's status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

@kimberlysias6642 Um no. I'm the only one here paying attention to the real problem.

@markacatania at what point was it working, we have had record numbers ever since it was created. I don't think it does what you think it does.

@jeffhobbs3948 I'm the only one in this comment section that is not. Learn our immigration laws.

you mean don't allow him to add context and facts the Right doesn't want to hear in a hearing for civilian oversight, because you want to hear rhetoric and propaganda.

Are we doing the same for Trump for violating Federal law? Several times.

@johncostello6006 I get it from doing the research and not by being a puppet for right wing rhetoric and misinformation. Your understanding of the issue with the cages clearly shows you don't know anything except the propaganda you hear.

@waltbirchmeier2947 8 USC 1158 and 8 USC 1125. Thanks for asking a real question.

@davidblyth5495 your head lingers up your ars. It's called facts and context your side leaves out and it's responsible for this issue and making the Right wing base low informed and stupid

@grahamhebert2931 Not complely his fault, but he did make things far worse then they were before he came into office.
