  1. They need to have probable cause and reasonable suspicion to detain you. They have a right to ask the question and a citizen has the right to refuse to answer. The purpose of detaining or going to a secondary check point is to look for a probable clause, but this requires reasonable suspicion that they are required to tell you. Not answering the question is not responsible suspicion.

  4. The law has been around for 50 years. Dems are trying to change the law from 100 miles to 25 and only to physical borders. It's not getting support from the right. Trumps policies have ramped up the use of this rarely used policy and reasonable suspicion to look for probable cause is being abused.
