@Chugwater_Cowboy Forcing asylum seekers to remain in Mexico at the hands of traffickers and cartels for a start. Asylum seekers are to be detained in the country after they have passed a creditable fear interview. Title 42 and remain in Mexico violate those asylum rights. Under title 42 there are no charges for crossing the border so they are deported and they cross again. there is no title 8 immigration enforcement under title 42, it suspends that enforcement.

We had a 17 year decline in southern border crossings to the lowest point in 50 years, prior to Trump and his policies, by following our INA laws that have been in place for 40 years. By 2019 Trumps policies doubled the number of people being apprehended at the southern border to 977,000, a 20 year high. Covid is what reduced the numbers in 2020, but only for the first 9 months. By October of 2020 apprehensions under Title 42 were back to a 20 year monthly high. It remained a 20 year high and growing ever since. So what was title 42 doing to keep them out? All it does is it suspends title 8 immigration law authority. That means in an effort to stop legal asylum it is also suspending penalties used as a deterrent for those crossing the border. That means we have about 405 who are repeat crossers and that is inflating apprehension and "gotaway" numbers. Title 42 is helping to eliminate the ability to punish the criminal activity.

It also suspends 8 US code 1325; the misdemeanor that carries a civil penalty for crossing the border. And 8 US code 1326; stiffer penalties for crossing the border. That leaves out any legal penalty or deterrent for those crossing. All we can do is deport, and many re-cross again with no penalty in place. That causes our apprehension numbers to be inflated and the get away numbers to be inflated....

breaking what law? The laws that the Right keed undermining, because the Right doesn't like the immigration law?
