  1. They can, MLMs aren't illegal on its own, pyramid schemes are illegal but if Herbalife actually gets their products sold every once in a while it's not that easy to prove and I don't see obvious signs that Herbalife could be accused of it in front of a court

  2. Also, the main purpose of the SEC is to supervise the trading and protect the investors from fraudulent activities and Herbalife is profitable for the investors. Other things like if people selling for them are actually making money aren't that much on their priorities
