I think the biggest basis for proving gross negligence, or that the waiver was misleading, is that oceangate's own documentation shows not just the widespread concern over the carbon fiber hull sustaining damage through pressure cycles, but the fact that they had actually documented this very thing happening on the sub's hull. they knew it was cracking and delaminating. the waiver is worded as if the safety level was unknown, but in reality they knew for a fact that it was highly unsafe because the sub's hull was failing.

  3. they did have the basic knowledge of the pressure, and lacking that was not what caused the implosion. the problem was material fatigue from pressure cycles after a dozen successful dives, otherwise best known from pressurized airplane hulls, which are sold with a recommended limit for how often the plane can fly to high altitude and back down before its structural integrity is no longer guaranteed. oceangate just skipped the fatigue testing entirely, and used these manned dives as fatigue testing - which is a pretty sure way to achieve exactly this result.
