  1. The one thing I'll say is that civilians suing a general over a military decision is inappropriate. The matter should be taken up by a court-martial. There could have been a valid reason to send a plane into a combat zone. The matter of negligence should be judged by officers who have a full understanding of the tactical and strategic matters involved, not civilians who have never had to make a hard call that they know will wing up killing their own men. The hardest order that an officer can give is one that he knows will result in the deaths of his men. It is his duty to give that order if the loss is necessary. It is the duty of HIS commanders to make sure that such an order is not handed down lightly and without good cause.

We don't know enough about the circumstances involved to decide if it was poor decision making or a poor outcome of strategically necessary orders. No civilian court can possibly make a valid judgement. That's why military boards of inquiry and courts martial exist. They only people who can judge his decisions are his direct superiors and (if negligence is probable) his fellow officers empaneled in a court-martial.
