I disagree. There needs to be more proximate cause to the incident. If you buy somebody (who's never been violent) a gun, and then later days later with different circumstances and different environmental conditions. He uncharacteristically becomes violent and uses that gun to kill people. The parents aren't the direct cause of the homicide. But if the child was vocally and conspicuously violently Disturbed and making threats and then--THAT DAY--and the parents said, “You know what would be a great idea for you? Why don't you blow off some steam by shooting the squirrels and the hogs behind the high school. That always helps your mother get her anger out..” And then the parent proceeds to hand the child the gun: then I would concede that:👇🏾 That is incredibly and grossly negligent. And all the EVENTS are happening on the same day<<AND>> IN A COHERENT, CAUSAL, LOGICALLY•LINEAR CHAIN.. But to say that just because she bought the gun for him, that implies that she wants him to use it on humans and it implies that she should have foreseen that people with mental health challenges are violent. And all violent people with mentally ill issues are violent every single day.. I mean this is an extremely easy case to Toby but not necessarily at the preliminary stages of the case. Because the defense has the burden to prove why there shouldn't be a trial. But you can't prove beyond A reasonable doubt two crucial elements of the case: 1) the moms mens rea in relation to this crime 2) the quality of her relationship with her son as it relates to her ability to psychiatrically forecast his behavior on any a given day.
