  1. A lower court can set a precedent that is subsequently upheld by a senior court on appeal. So if the government have any sense of justice, they should appeal this decision, because this reasoning is weird. Good law is understandable by ordinary people, and if it quacks like a duck, looks like a duck, it's most likely to be a duck. And intending to deceive is the mens rea of fraud, so how this judge reads the existing law is a misreading of the existing law, and a misunderstanding of how modern markets work.
