  1. I tend to believe there is a presumption of guilt that will or will not be successfully prosecuted. The judicial system does not find an accused person innocent it basically tells everyone there was not sufficient evidence to prove guilt. Amesbury has been charged with common assault (Sec 39) which is the least serious offence. I think if you or I had done the exact same thing the charge would be ABH(Sec 47) because of the seriousness of injury caused by 6 hard blows to the undefended face and head.
