I have no opinion, because I don't know all the facts, but I don't see how this video proves very much other than he set off at three and returned at four thirty.

@orezmo140 In my country (UK) he would be facing a murder charge, because he no longer had reason to defend himself. As for members of the public there would need to be some indication someone was in danger of being shot to warrant the shooting. Without this the motive would be seen as unnecessary retaliation/retribution in anger. A mitigating circumstance could be temporary loss of mental ability resulting from the blow to his head.

@Vanlifecrisis Usually, if someone other than an official points a gun at you - you are within your rights to shoot them. Exception might be if there was reason to suppose the gun would not be fired at you.

@jtcmlt1 I think the defence here would be he received a severe blow to the side of his head with a heavy steel pistol and this blurred his thinking. Any prosecutor would be aware of this and that a jury would accept that argument as being acceptable excuse for excessive reaction. Attitude is on the side of the 'good guy' in the US. I was in Seattle once and a car thief was chased by the car owner and when he stopped to give way to traffic the car owner shot him dead through the driver window. The news was saying the killer was 'ex military' saying the police were seeing what could be done to get him off - I was thinking 'this would be straight up murder in the UK'.
