Someone who does not actively think about what could happen to another person, such as Grace and the poison sugar can be blamed if it could be determined that they would have acted differently if they were putting the sugar/poison into their own cup. Either way I don't think there is any innocence here, it is a crime and punishment is needed either way to motivate others and thinking in the future.

Programming people to be evil is a major effort of all our big societies, watch that kid that rationalized evil behavior of the pirate ... because if people accept this they will be a much reduced threat to the social order ... whatever that order may be. One has to wonder if the social order in the US/Constitution was indeed motivated by religion when people were indoctrinated with good, opposed to now where our media show us mostly evil, covered by a thin veneer of good?
