Cohen's credibility was shown in court today by the photo of Schiller and Trump together at the crucial date and time. All 34 counts seem to have been proven. If the Jury agrees Trump could get over 100 years in a NY prison. In prison, after declining to testify, Trump will probably (like a famous German did almost 100 years ago) write a book called, "My Battle" but of course since Trump famously said he believes war veterans are loses and he is not one, hardly anyone will bother to read it and 50 years from now hardly anyone will remember the name.

In any case it is not unusual for attorneys to record conversations during negotiations. Secretly or openly, all participants (not on Federal property) of a conversation (and those lawfully present) have a Right to do so (Katz v. US). Best way of proving what was said during a negotiation if things go South. Now that body cams are so small and cheap, lots of Americans wear or one on in their pocket anyway. No one should be surprised at being recorded by someone when they say or do something stupid. Also Dershowitz seems to be ignoring the State of NY has placed the entire trial transcript of each day, sidebars and some of the evidence are posted online each day for free downloading or reading. So anyone concerned about what is said or shown in court can read it all (for free) without media filtering.

  10. Such BS. Read the transcripts. Trumps team declined the Advice of Counsel defense very early on. Probably because using it would have forced Trump to testify. And, as we all know in spite of all his BS about how he wanted to testify to the media outside the court house, in the moment of truth when specifically asked to, he refused and pled the 5th. Regarding the non segregation of the jury, in NY if the Defense wants that they have to ask for it at the beginning of the trial. Not the court's job to remind them, or the court's fault if they forgot to make that request. Maybe his appeal basis should be incompetent defense? They certainly seem to be.
