So obviously s new lawsuit between Cohen and Dershowitz will soon be announced if Dershowitz can't actually prove the reason given for the recording is a lie. Whatever. In any case it is not unusual for attorneys to record conversations during negotiations. Secretly or openly, all participants (not on Federal property) of a conversation (and those lawfully present) have a Right to do so (Katz v. US). Best way of proving what was said during a negotiation if things go South. Now that body cams are so small and cheap, lots of Americans wear or one on in their pocket anyway. No one should be surprised at being recorded by someone when they say or do something stupid. Also Dershowitz seems to be ignoring the State of NY has placed the entire trial transcript of each day, sidebars and some of the evidence are posted online each day for free downloading or reading. So anyone concerned about what is said or shown in court can read it all (for free) without media filtering.
