I think it was a major mistake of the Special Counsel to not stop at the definition of Reasonable Grounds or Probable Cause and instead give speculation about the outcome of a trial when making a decision as to if the crimes should face prosecution. He should have used extenuating circumstances for a no prosecution decision. The way he did it slurs the accused while leaving Biden no safe way of arguing against the slur. Alternatively, for Trump to use senility as a defense would very much go against everything he claims about his own mental state. I doubt his ego would permit that defense.
