Both are illegal, the ones defrauding benefits (if deliberate & it usually isn't) are usually claiming something to which they are morally but not legally entitled or something to which entitlement has been withdrawn during the period of a claim. Those avoiding taxes are denying benefits to the most needy, denying civic maintenance (like potholes) & denying civic improvement.
