One of my favorite toys when I was a kid was the Whammo Air Blaster, a "gun" which would fire a ball of compressed air. This effect was achieved by cocking a lever which would retract a rubber diaphragm, which was released when you pulled the trigger. Of course, kids put pencils in them. Everybody is focusing on the term "insurrection" and ignoring the phrase "or rebellion against the same", the words "the same" being a clear reference to the Constitution. Since the term of the President is defined in the Constitution as ending on a specific date and time, it is arguable that his attempt to, shall we say, overstay his welcome constituted a rebellion against the Constitution. Furthermore, looking at the "aid and comfort" phrase and trump's actions (and non-actions on the 6th) it is arguable that he meets that definition as well with the dangling of pardons and saying "We love you. You're very special."

The fact that these LGMs are following a "catch and release" protocol means that the arrests are bogus and they KNOW it. They don't care if those they pick up have committed vandalism or any other crime, it's an intimidation tactic and the sheer randomness of it is PART of the intimidation. And the intent, as you point out, is to undermine the exercise of a legitimate right. Do all these factors, when taken together, constitute conspiracy to deprive folks of civil rights?

I always thought that the Court got it wrong on Westboro. Was it ever argued that a funeral is itself a religious service and that the Westboro folks, in disrupting it, were interfering with the first amendment rights of the funeral attendees?

I know that you're trying to focus mainly on trump's words here but doesn't his providing a venue (no less official a venue than the friggin' White House, in fact) give him an added layer of culpability for the words of other speakers (including his own son) that none of his admittedly artful usage of "weasel words" can remove? And how about the possible application of the conspiracy law used against the "Chicago 8"?

While not as frivolous as these the publishing company that owned the rights the songs of Creedence Clearwater Revival once sued John Fogarty, the groups founder, because his post-Creedence work sounded too much like their "property". In essence, he was being sued for plagiarizing himself.

Legalisms aside a president derives his power not from the Constitution, or even the people, but from the simple fact that when he give orders, people follow them. If people in high positions continue to follow his orders after the legal expiration date of his elected term of office, then he is still president, in fact if not in law.
