It wasn't independence in Barbados, it has been independent since 1966, it became a Republic. The Queen of Barbados was a different legal person to the Queen of the United Kingdom in international law. The Queen of the UK is not the same as the Queen of Canada, no one says Canada is not independent. Barbados simply changed the legal fiction of having a Head of State who was personified by Elizabeth I of Barbados, with the Governor-General happening to succeed her as Head of State.

The Ukraine was a member of the United Nations before Russia was. It was a founder member, Russia only inherited the Soviet Union's membership of the UN. No one gives any cogent reason as to why Russia has some right to invade another UN member state, or any reason why the general rules of international law do not or should not apply to Russia. Mr Trump was and remained hopelessly naïve as the President. He lacked the will and means to eliminate or even temper the inertia in the bureaucracy that was hostile to him. He needs to look at what Erdogan did after his coup (not to copy that) but to see what determine to hold and wield power looks like. Someone like Ted Cruz as A-G might have helped.

I think that the panel would have benefited from reading the judgment that they are discussing, and to understand the distinction between the claim and the counter-claim, in the counter-claim a defence was available that was not possible in the main claim for defamation.
