  1. Obama couldn't have put Elizabeth Warren in with a recess appointment because the Senate wasn't in recess at the time. She withdrew herself from consideration for the job, and Obama nominated Cordray. Cordray got blocked by Republicans too, so when there actually was a Senate recess, Obama installed him via recess appointment. By that point, Warren was already a declared candidate for the Massachusetts Senate seat, and thus no longer an option for the CFPB position.
