  1. The EU doesn't have the 14th Amendment or anything equivalent. EU citizenship, of course, comes from being a citizen of any EU member state. Most EU members states grant automatic citizenship to anyone born there so long as at least one parent is a legal resident of the country for a period of time (most often 5 years).

  3. There's nothing to be defined. And the 14th Amendment makes no mention of parents. What jurisdiction the parents are subject to is completely irrelevant.

  4. It's not a "loophole", it's the Constitution as actually written. And our founders were all dead for decades by the time the 14th Amendment written.
