That bit about the autopsy report...that's why the prosecutors should indict the medical examiner as an accessory after the fact to George Floyd's murder. Doing that would help to destroy the credibility of the fake autopsy report that was designed solely to help Chauvin get away with murder.

@jayc5373 Premeditation doesn't need to happen a significant time in advance. If for example you see somebody you've got a grudge against walking down the street and say "I'm gonna kill that son of a bitch", then pull out a gun and shoot him dead. That would be premeditated. You wouldn't have needed to decide when you left home in the morning that this was the day you're going to kill your enemy. Consciously deciding on the crime when you see the guy and immediately following through on it would be enough for 1st degree murder. On the other hand, if the situation was that the two of you are having an argument, and he says something that enrages you to the point that you pull out your gun and shoot him, that would be 2nd degree murder. A fit of rage is not premeditation, though it is an intentional killing.

@ryanx9372 Premeditation can still happen in the moment. If Chauvin saw a guy he's got a grudge against and decided "I'm going to kill him now", that would be 1st degree murder. The problem is, while that scenario is plausible given that they had a history, how would anybody go about proving it? The only ways it could be proved would be if Chauvin confessed, or if told his fellow officers that's what he was going to do and one of them flipped on him. And even if it actually did happen, there's no way any of them would admit it. tl;dr It might actually have been 1st degree, but if it was it would be impossible to prove.

He can't.

Given that Chauvin personally knew George Floyd from them working as security guards together, 1st degree murder isn't at all implausible. He might well have decided this was a good time to kill somebody he had a grudge against.

The medical examiner who claimed Floyd didn't die of asphyxiation should be indicted as an accessory after the fact to murder.
