Like his open advocacy on multiple occasions this year for a military coup. Seeing as a retired officer is still an officer, Flynn can be court-martialed for that. A civilian couldn't be charged with a crime merely for saying that a coup should happen. They'd need to be at a minimum involved in actually plotting such a coup. But an Army officer can tried under the UCMJ for it.
