  2.  @jamesbyrne4335  those who failed to meet the regulation should pay. It is unfair to expect the home owner to correct something which they could not be expected to know about in advance. The same could be applied to a myriad of specifications involved in a building. It cannot be a case of buyer beware, as that would require the home buyer to have a high level of expertise in many building disciplines. It is more a case of consumer protection, and the product being fit for purpose. At the very least the legal system should recognise that the supplier and associate supply chain should be held fully accountable for defects in the building, its construction, and its materials. The trail of legal responsibility should not stop at the first one to go bankrupt, but continue to those responsible for the failure. It is simply unreasonable for the consumer to be held responsible for every detail of a buildings construction, simple because they purchased it. There was no price discount given to the consumer for having acquiring the knowledge.
