When you mentioned insurance companies enforcing the property rights of their clients (something like that) in absence of a government, it brought to mind the "protection" provided by the cosa nostra. The state as a naturally organizing entity will be voluntary for a majority. It was referred to as "a necessary evil" by Thomas Paine. If men were angels, it would not be necessary (Federalist), but as we are going to have crime and grievances, there is going to develop something with courts to decide cases and controversies that are not settled by the contesting parties. if a person loses a case, then the state must have recourse to at least coercion if the loser doesn't voluntarily admit wrongdoing and pay the restitution.
