The 4th Amendment applies to private property. It doesn't apply to government offices and computers, you have no right to privacy with work computers. Government representatives who are authorized by the president can search offices and computers at their leisure, no warrant is needed. Next, DOGE has been authorized by the president, they make recommendations to the president and he can act on them or not. Congressional approval is not needed for advisors to the president.

It's a separation of powers issue. Judges can't really interfere with the executive branch auditing itself.

@PyrrhicPax It has been formed in accordance with Article 2 of the US Constitution, it is not a cabinet level agency, so it doesn't need congresses approval as they are advisors to the president. Just like the president doesn't need congress to appoint a press secretary, chief of staff, white house cook, they are staff positions.
