The reasoning behind this is because in divorce and custody cases anything can be brought up, and it is hard to prove marital rape. Some people are so submissive that they enjoy being dominated in that way. And what goes on in the private home is really none of the government's business. But say you have a situation where one person is submissive and enjoys this, does it more than once with their spouse, then their spouse cheats on them, you get into a legal battle of he said she said.

The reasoning behind the law is that in divorce and custody battles things can get very dramatic and complex. Some people are submissive sexually to the point they enjoy the other person taking control to the point it is basically rape. Say you have couple that is like that and they have done it more than once. Than one cheats on the other leading to a divorce. The submissive partner can claim they were raped and abused during the relationship leading a more complicated custody and divorce battle. It also goes back to what goes on in a person's, our married couple home is none of the government's business. So there is more to it than what people are saying.

shygirl2927, what I am showing is that rape is subjective in some ways. You are married to someone so basically a lot of what you do is consensual. Where is the line when it isn't? We can't tell because why marry them to begin with if you have problems? That is why the law exists. Calling sexual activity between two people who agree on things and it is aggressive is not rape.
