Ace Diamonds There are zero reasons to create redundant laws. All it does is add layers of bureaucracy. The 14th amendment is clear, the state can discriminate. The constitution gave the people freedoms and placed restrictions on government. Banning slavery is allowing more people to have freedom, same with allowing women to vote. The federal government telling a business how to run is the exact opposite of what the constitution was designed to do. You have to realize your argument is weak on support of centralized government.

Josh Wilson And why should sexual orientation be recognized as a protected class? When you apply for jobs, college or anything else you are not asked what sexual orientation you are. So why does it matter? When you apply for HUD do you have to put down your sexual orientation? And if so, than lie about it. You can hide that. You can't hide your race.

Ace Diamonds The 14th amendment prevents the government from punishing someone or restricting someone unequally. With gay marriage gay people can still get married, it just has to be with someone of the opposite sex if they want the government to recognize it. They are not denied anything. That is the point. Interracial marriage did deny people equality though. The reason why is because the local government recognizes marriage as between a man and a woman for several reasons, thus as long as it is between a man and a woman that is the only standard. Abortion is not covered at all in the 14th amendment. Roe vs Wade was an incorrect ruling. I support the 14th amendment in its entirety. I just understand what it says and how to apply it.

Ace Diamonds With race you can't change your race. You go out in public people see that. You can hide your sexual orientation though. What you do behind close doors is your privacy, but in public you have lots of restrictions. You can't cover race though. That is why the government can't discriminate based on race.

yootubevids Marriage is a state issue via the 10th amendment. It is no different than zoning laws, education, driving laws and so on. It is state and local government creating laws to put their communities in the best position to succeed within the confines of the constitution. Marriage is not a right protected by the constitution. You have the right to pursue it via the right to pursue happiness, and in doing so no government can oppress you. But whether or not the government recognizes it is up to the state and local level. Now via the 14th amendment the government can't discriminate. That is vague though. They can't by race, and that was the ruling in Loving vs Virginia. If the law says marriage is between a man and a woman than they government has to allow interracial marriage. If the law say between two people than it has to allow gay marriage. If it just says between a man and a woman than you have an argument that they don't have to recognize gay marriage. It comes down to if it is the best interest in the community to allow gay marriage to be legal. That is the issue.

curioussebastian No. The 14th amendment just says means that everyone is treated equally under the law. If the law states that it is between a man and a woman than that is what marriage is. A gay person can still get married as long as it is with someone of the opposite sex.

curioussebastian Nope, marriage is a state and local law if they decide to recognize it. If they do they have their way of doing it . If they see it as between a man and a woman than that is how it shall be. It is no different than zoning laws that exist in certain parts of cities. If someone wants their marriage to be recognized by the government it has to be between a man and a woman unless that state and/or local government will recognize gay marriage.

curioussebastian I understand what the 14th amendment is. The 14th amendment does not cover gay marriage. Even at that the 14th amendment is not really a law, it is a restriction. " States do not have a right to deny rights to Same sex couples" And they don't, marriage is not a right. So they are not denied anything.

curioussebastian Same sex marriage is not covered in the 14th amendment. How many times do I have to tell you? Gay people, like everyone else, can have the benefits of marriage as long as it is with someone of the opposite sex. The question becomes why do married people get special benefits where single ones don't? That is not equal. Why am I, as a single guy, denied things? Fact is that a I am not denied them though. I can receive them if I get married. I can get married now, it will be with someone I am not in love with. You see the issue? If I want the benefits of married people in my current situation it will have to be without love. That is not what I want? But that is how it is. I can cry, bitch and moan about how married people have special rights. Or I can understand the constitution and realize that is how the law works.

curioussebastian Marriage comes with privileges and benefits, just like owning a business and having a license, not rights. Your rights are clearly listed in the constitution and marriage is not one of them. If a gay person wanted those same benefits they need to marry someone of the opposite sex. Just like me, as a single guy, if I want those benefits I will have to marry someone of the opposite sex without loving them. That is how state laws were written. No one was losing any rights. If you want to make an argument on equality than I can easily that why me, as a single guy, I don't get the same benefits as a married person? The SC has ruled incorrectly in the past. Look up Kelo vs City of New London.

Ace Diamonds The Civil Rights Act was some parts unnecessary due to the 14th amendment and some parts unconstitutional due to the 10th amendment. But I guess we should go back to the days before the 1770s when we had a centralized government ruling us and an oppressive government.

Race has nothing to do with it. People are multinational so if you start mixing race in it than you have to get deep into someone's heritage which, overall, limits freedom's beyond someone's control. The state, if they see no advantage to two members of the same sex getting married, then they won't recognize it. The same for someone having 5 wives. yootubevids Marriage is not a right, that is the issue. Just because the state does not recognize gay marriage does not mean they are taking away a right. If you want to play that game why do married people get tax breaks? Why do people who decide to go to college get tax breaks? As is all laws are unequal in some way.
