@austinhernandez2716 the SC did not. it is written in the Constitution what their duties are.
"The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—to all Cases affecting Ambassadors, other public Ministers and Consuls;—to all Cases of admiralty and maritime Jurisdiction;—to Controversies to which the United States shall be a Party;—to Controversies between two or more States;—between a State and Citizens of another State,—between Citizens of different States,—between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects."
The 9th amendment is an elephant in the room, I would agree. However, the challenge is that if you want to refer to that then murdering people is a right, or driving drunk is a right.
The 14th amendment has nothing to do with abortion. And a woman has control over her body. They decided to have sex. So there is that.

@keirfarnum6811 abortion was never challenged at the time on the legal matter. Thus, abortion was not seen as a right. The constitution limits what all governments cannot and cannot do. There is no right to medical privacy. Even if so, the government can still investigate you. If abortion is illegal and the government suspects you had one they can investigate your medical record. Just like they can investigate if you have a mental disorder. Also, I find it ironic how many on the left want medical privacy when it comes to abortion, but when it comes to owning a gun they want people to do mental screening.
Saying separation of church and state means government should not be involved in religion, period. That means government officials can't be religious, government cannot help churches if a crime is being committed against them, etc. However, that is not the case. The 1st amendment says government cannot establish religion nor prohibit the practice of religion. Government can still be involved in religion in many situations, and is.
What fundamental rights are being taken away? Also, people still care about the economy over all of this. Abortions have been dropping for years and only in very blue parts of the nation do people care. Other parts do not.

@medude420024 to start, you don't know my actual stance on abortion. If you knew you would be surprised.
Next, the concept is to limit governments. Abortion is not in the constitution, thus it goes to the states. Almost all issues have subjective and objective sides to them. With more local government the subjective issues are handled better based on what the people want. You may support abortion being legal, but many people in many states don't. Who are you to tell them how to live their life if you don't live in that state, you don't vote there, you don't pay taxes there, etc.
Also, most important point is this. When the federal government made abortion legal you may support that. But now you gave the federal government that centralized power. Say, now with Roe v Wade being overturned by justices selected by republican presidents, how would you feel if republicans place a national abortion ban? I would oppose it based on how I support state rights, but you are the one who wants a centralized government, not me.
