  1. Flag burning should be legal based on the 1st amendment. On a legal aspect, they can get him for starting a fire in a neighborhood. Just like in some areas you can't start a bonfire in your backyard because it puts other houses at risk. As I said, burning the flag is legal based on the 1st amendment, but there are ways around this if someone wants to punish this guy.
