The 8th amendment "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." The key word is punishment, they are not punishing anyone here, they are torturing instead. Torture can be cruel, it can be unusual, but it isn't being used as punishment thus it is legal. Even if there is something morally wrong here or it doesn't work it isn't unconstitutional. Kyle needs to read that 8th amendment again.

It isn't unconstitutional. Cruel and unusual punishment is. That is the key point, punishment. Interrogation isn't punishment. I don't agree with it but it is what it is.

Look at the word "punishment". As long as you are not using it for punishment than it is legal.

MIndja Bizniss It is about it being constitutional. In the constitution it is banning punishment. It doesn't say anything about interrogation.

How so? What Kyle said wasn't too bright. Kyle doesn't understand he difference between interrogation and punishment. That is why that torture wasn't unconstitutional because it wasn't punishment. It might have been cruel and unusual as Kyle pointed out, but he failed to see the punishment part.

Randall Vance It isn't punishment. Punishment is having someone pay for their crime. This torture was used as interrogation. They were not being punished for anything but instead being interrogated. I don't agree with it but it isn't unconstitutional. I agree that the constitution is to place limitations on the government. Problem is that we don't follow it anymore.

andresemilfer Ok, now who is going to enforce what the US signed. That is the bottom line here. And locking people up isn't cruel and unusual. Without trial, they are not required to go to trial since they are not criminals but instead prisoners of war. There is also a small argument that they are not granted any constitutional rights since they are not US citizens or in the US legally. I don't buy that but that argument does exist.
