It is unconstitutional because the president is stepping over his bounds and not going through congress to do this.  This basically is allowing Obama to be a dictator and doesn't set bounds on what he can do.  The constitution lists the powers of the president, he doesn't have the right to do this. On torture, it is cruel and unusual punishment that is illegal, the key word is punishment.  This is been discussed.  The people being tortured were not being punished, they were being interrogated and thus that is why it wasn't unconstitutional to do that.  Also, there is the argument that they were not American citizens thus they are not protected by the constitution.  That is a weak argument to me but is does hold some weight.  There is some questions of if Obamacare is constitutional, a lot dealing with state rights.  How can the government enforce a law forcing citizens to buy healthcare insurance? Both parties violate the constitution, and Kyle has no understanding of the constitution.
