  4. "Yelling Fire" in a crowded theatre was only a metaphor used by SCOTUS, it was not a "TEST" as Walz said, and only in context of telling men not to sign up for the draft in WW1. Walz has no idea what the 1st Amendment means, Vance does, and could have wiped the floor with him.

  8. Yes, the moderators lead Walz to the answers in rebuttal. In court that would be objected to and sustained. Vance saw it, but didn't take the bait. He was grace under fire.

  11. Schenck v. United States decision "shouting fire in a crowded theatre" was used incorrectly by Walz. and has been changed since rulings like Brandenburg v Ohio in 1969. The context of the "shouting fire" ruling was during World-War-One and specifically related to that "clear and present danger". SCOTUS wasn't talking specifically about a fire in a theatre, it was a metaphor, not a "Test". Tim Walz didn't go to Yale Law School, he should thank Vance for not taking him to school on this stupid remark.
