The International Criminal Court (ICC) doesn't have its own police force or prison system to detain individuals. However, it can issue arrest warrants for individuals accused of crimes within its jurisdiction, and it relies on member states to enforce these warrants and carry out arrests. If a person is arrested and brought before the ICC, the court can then hold trials and, if found guilty, impose sentences, which could include imprisonment. So, while the ICC itself doesn't directly put individuals behind bars, it can play a significant role in the prosecution and punishment of those responsible for serious international crimes.

As such, individuals from Gaza, as part of the State of Palestine, fall under the jurisdiction of the ICC for crimes committed within its mandate." - ICC There is no "State of Palestine", no way for them to "ratify" their inclusion into the ICC as required. I don't see any case standing up under that circumstance. Israel did not act against this so-called "State" which never ratified inclusion in the ICC, they went after a terror group, Hamas.

The ICC jurisdiction covers any individual acts in Gaza, that includes Hamas and Islamists, so careful what you wish for.

@ulsia6740 In 2015, South Africa also failed to arrest then-Sudanese leader Omar al-Bashir, who was also the subject of an ICC warrant.

@ulsia6740 Yes, we agree. It complicates life for all parties involved. I want to THANK YOU for this discussion. It motivated me to learn quite a lot about the ICC process and jurisdiction, especially the inclusion of the "State of Palestine" which the ICC has not recognized as a sovereign state, but did accept membership. Very, very complicated, one that puts Palestinians at risk, too.

According to the president, South Africa is seeking an exemption under ICC rules based on the fact that enacting the arrest could threaten the “security, peace and order of the state”. “It would be inconsistent with our constitution to risk engaging in war with Russia,” he said, adding that this would go against his duty to protect the country.

As an example: "In a move which provoked anger in Moscow, Armenia's parliament voted Tuesday to join the international criminal court (ICC) - ratifying the treaty it had so far only signed, at its 1998 inception. Citing the will to address alleged war crimes committed by Azerbaijan in the Nagorno-Karabakh region, Armenia's prime minister has sought to assure the Kremlin that joining the ICC is not a change of course aimed at its traditional ally Russia." ICC Many countries have signed but not ratified, others have neither signed nor ratified, and some have pulled out. If the court is used for selective enforcement, more will pull out, or join temporarily to use its services. Really a mixed bag, nice try, and I agree with having a meta-Court system over the framework of nation/states, but we are not there yet, not in the evolution of human beings. Look at a map of those who have not ratified or even signed. Pretty telling.

@mashkanyc ICC accepted an application, although I did not find out exactly from whom, and included them in ICC membership. That's a fact, but still very complicated when it comes to a case brought against any Israeli in Gaza or the West Bank. However, it cuts both ways, if upheld, then the ICC has jurisdiction over any acts by individuals, including those by Hamas and Palestinians.

@benik3297 Yes, I read the full description and the West Bank and East Jerusalem was included, but nowhere does it say it was the PA, so can only assume. In any case, a bit sketchy from a legal standpoint.

@hakanozaslan9571 the ICJ does not go after "individuals" While both the ICC and the ICJ are international judicial bodies located in The Hague, they serve different functions: the ICC prosecutes individuals for international crimes, while the ICJ settles disputes between states and provides advisory opinions on legal questions.

@roystonmason9125 Barely, the ICC does not recognize it as a sovereign state, but as a member, which makes any "warrant" complicated. Membership means Hamas members and any individuals in Gaza and the West Bank also subject to indictment. Careful what you wish for.

@ulsia6740 The SA president issued a statement saying Putin would not come based on "mutual agreement" but would fully participate by video, which he did. The SA President said it would be an "Act of War" to arrest him. In 2015, South Africa also failed to arrest then-Sudanese leader Omar al-Bashir, who was also the subject of an ICC warrant. I'm saying, as in my original comment, if Putin did attend, SA would not have arrested him and break their close tie with Russia and neutral stance on the war with Ukraine. A full reading of what happened, even on al-Jazeera, will make that clear.

@ulsia6740 I'd add, that not only would SA not arrest Putin, they would arrest Netanyahu, and there lies the problem with the structure of the ICC.

Palestine was a region created by the Roman Empire, controlled by the Ottoman Empire, then under international mandate, which eventually led to a Palestinian state called Jordan, and a couple of years later one called Israel. Israel has 1.8 million Palestinian/Arabs, 21% of its population.
