@Roamingeast if I'm flying a drone and you're getting carried on a stretcher by two combat capable soldiers, I'm dropping. I need to get those two. It's cruel? Too bad.

Not all countries have signed that convention, and countries which have signed the convention have argued their cluster munitions do not fall under the spirit of the convention so they reserve the right to manufacture and stockpile them.

@toneth353 There's limits to gun depression. Sometimes using the vehicle as a weapon is the only way. In Iraq they formed a defensive line with a large trench. The US gave the Iraqis ample chance to surrender then came in with armored bulldozers fitted with RPG cages and buried the enemy soldiers in the sand. It's not pretty, but trying to use guns and explosives to clear the trench would be just as violent and expose coalition troops to greater danger. So if the vehicle can be used to crush or bury an opponent who refuses to surrender, it will be.

@toneth353 I watched the video and the interview. They spent the ammunition because there were more enemies in the area than expected. It's not sadism. Once over the trench, they cannot depress the gun. They only had one shot left and needed it in case they had to fire back at someone else. So tracks it is. I'd drop bomb on the wounded to score a hit on the two health soldiers carrying the stretcher. I don't care. If it were me having the country invaded, I have to continue to add numbers to my count, because the faster I get numbers the sooner they leave my land. Why should I show mercy and spare two fully combat capable soldiers? Next day they could kill my friends, or execute civilians like in Bucha. I'm dropping. The wounded guy doesn't deserve it? Life's unfair. Wear a cup. Bad timing. Should have stayed home.

If one person went to prison it was a war crime. Or are you saying he's innocent?

@SebastianHaban the M193, M855, M855A1, Mk 262 and Mk 318 ammunition for 5.56 and some European M80 ammunition for 7.62 deform on impact. Yet those are used and not considered war crimes.

It could damage optics and viewports, forcing the crew to open the hatches and put their heads outside the tank to see.

@jb13611 gun depression has limits.

The pilot would have no means to take a prisoner in that situation.
