His defense team is reaching and really reaching at the end of the day. They are just HELL fired pissed off because they didn’t get a preliminary hearing. I honestly doubt the judge is going to dismiss this indictment and start over or give them a preliminary hearing when they start dating case laws from that far back that usually is a telltale sign that they’re in trouble and they gotta reach for something.
