They were lucky he had a trespass active since 9 years ago so it did not matter in the end.

@earl3092 He has a gofundme page for his legal fees. Apparently he got arrested again because it turns out he had an active trespass 9 years ago. He was trespassing and he's going to court for it.

True but later he was arrested again because it turned out he had been trespassed 9 years ago and the trespass was indefinite so it turns out he still broke the law.

A business doesn't need any reason whatsoever to trespass you.

@mikestock969 The guy had an active trespass since 9 years back regardless. He got re-arrested later, he has a gofundme for his legal fees and recently lost in court.

@taustin266 That was Florida though. Florida trespass can be indefinite if the company wants to do that.

@davidshumway9639 Yes, HE says it expires after a year but Walmart and the police says it's indefinite which it can be according to Florida law. Also just because you manage to get into a business and make a transaction after you have had a trespass warning does not mean it is legally over. The business has to agree to continue to do business with you again. They don't check your ID when you enter Walmart, if what you said was true then anyone trespassed could just sneak in the very next day get a small item go to the cashier and pay for it and claim the trespass is over. That is not how it works. Just because the Walmart staff did not recognize you as someone they have previously trespassed does not mean the trespass is lifted. If the trespass order he got was indefinite then there's not much he can do about it. It doesn't matter that they mistook him for someone else. If you trespass you trespass it doesn't matter how they found out you were trespassing it is still a crime.

He was released when the police realized it was a case of mistaken identity. Later he was again arrested because he had a trespass from 9 years ago that was still active. He recently lost in court.
