  46. That's not how it works. The landlord has to give the tenant advanced notice of eviction, then begin an eviction PROCESS thru the Clerk of Court. Landlord has to pay the sheriff's dept to serve the court summons to the tenant. Then small claims court will be held within 10 days. Theres a whole process. They cant just make u leave without going thru court.
