I think the reason they went with first degree is because the charges will get dropped due to not being able to prove he pre meditated to kill a sex offender and 2 others that were instigating an attack on him.

Steve Slade he literally had his pistol drawn in his hand while his forearm was shot a 5” hole in it. Pistol drawn at you less than 2 feet away while being attacked by two other people......it was a deadly threat he shot down. The guy couldn’t even disarm himself pun intended when his arm was shot. The pistol is stuck in his hand from muscle contractions. He was trying to shoot/ intimidate kyle with threats of deadly violence at the very least
