By law. You think anyone can be on the ballot. There are specific tests. You must be over 35 to be the Presidential ballot. Do you think a 12 year old can be on because the voters have a 'right'? there are specific requirements. Engaging in an insurrection against the US government is disqualifying. You don't need a legal conviction, just a finding. That's the law.

@swimminginthoughts The law doesn't say "convicted" of a crime involving an insurrection. It just says engaging in the conduct. The distinction is legally meaningful. Sorry bout that!

Anyway, it is certainly not unconstitutional. You are ineligible to appear on the ballot if you engaged in acts of insurrection agains the Federal government. Pretty simple. That's the test. That's the law.

No conviction of a crime is necessary to disqualify an insurrectionist. Trump is legally disqualified for what he did, regardless of any conviction. The law is clear.
