You are missing the point. The disqualification language in the Constitution and State laws does not say "convicted of". No one said he was convicted of insurrection. That's not the test. It's a factual question of whether he committed the acts, whether convicted or not.

@trentgilliam5192 right. "engaged in" not "convicted of". Big difference in interpreting the law. You don't need a "conviction" of insurrection to disqualify. You just need to satisfy the Secretary of State that factually it happened.

@zoki5602 He wasn't and didn't need to be found "guilty". The statute does not say anyone "who has been convicted". It says anyone who has committed insurrection. So it's a decsion of fact, not whether there has been a criminal conviction. But obviously you're not a lawyer.

No. Making license plates will be Trump's new occupation, but Secretaries of States can decide, and rule as a matter of law, who qualifies to be on a State ballot. What they can't do is create 11,000 votes for a losing candidate just because it's the President on the phone asking them to.

These statutes do not require a of a conviction of insurrection. The State can, under the statute, make its own finding of fact.

@skylarc6063 What you are saying is irrelevant. No one said Trump was convicted of a crime. Under state law, to be on the ballot he had to meet certain qualifications. He must be over 35, born in the US and not have engaged in an act of resurrection against the government. The law does not say "convicted of a crime" involving an act of insurrection. Big difference. So he met qualifications one and two but failed three. No prior conviction was necessary.

@kahanakahuna1470 Do you know what a "communist" is? Sounds like to you it just means someone you don't like. It involves beliefs about private property rights. What Democrat believes that there should be no private property and that all property should be owned by the state? Obama, Biden and Clinton are all Millionaires. That sounds pretty capitalist to me!
