  1. The problem is that the death penalty had to be unanimous. Only one juror held on to the life whereas the rest stated they wanted the death penalty. Since they could not reach a unanimous decision, it defaulted to life. That's Florida law in effect, basically and I believe similar laws in place in other states with death penalty.
