Controversial opinion: I'm not a fan of Trump and I think he should be jailed, but it doesn't seem constitutional to prevent someone from running when the crimes are still alleged. If Trump was convicted of the crime, then the disqualification would make sense.

The votes decided that Bush won. Gore just wanted to rerun the election in districts that favor him until he got the results he wanted. The court said that they had to rerun the whole state. Florida wasn't going to rerun the election because Gore didn't like the results.

@lawyeresq1984 Trump has yet to be convicted. If allegations were all that is required, then Republicans could abuse the process by saying Biden is taking bribes from China.

Excluding political opponents is not a sign of a healthy democracy. This could also be a can of worms that MAGA Republicans could use to try to exclude Democrats from running.

For those who think allegations are enough, what would stop Texas Dan Patrick and an elected, Republican, Texas Supreme Court from disqualifying Biden from the ballet due to allegations of Chinese bribery using circumstantial evidence?

@jeffreymcmahon3627 What about the other part of the 14th Amendment, "No person shall ... be deprived of life, liberty, or property, without due process of law." Elected state officials have removed rights without Trump being convicted of a crime through a court of law.

@kene9632 Who gets to decide that? You? An elected Attorney General or Secretary of State? A panel of judges? We have a 12-man jury system for a reason.
