  3. What the average listener hears is the beat, the hook, and the melody. And the beats are almost identical. She took the hook almost verbatim, and the melody also has a similar rhythmic feel to it. Like you said at the top. She probably heard it and unconsciously copied it. You can’t take the core elements of someone else’s music and then just put your own (similar) melody on top of it. Rappers got nailed for infringement in the 80s for doing that.

  5. No. Music is all the components together. She basically took the riff, and all the rhythmic elements of the first tune. You’re trying to split hairs here. One Note Samba isnt without a melody simply because it’s a single note.

  6.  @legal_action3009  Tone is subjective. It depends on what it is you want to hear. Most modern takes on “Vox” amps are slight darker and less chimney…but it makes the distortion more usable. EL84 distortion can get really fizzy and nasty sounding.
