  1. Regen braking is easy or hard to implement depending on exact motor technology that was used combined with the inverter. Both were nearly prototype things in original Roadster so I wouldn't be overly surprised there were lots of issues with regen braking.

  2. Martin Eberhard had to step down as CEO in August 2007, asked by the board led by Elon Musk. Tesla built first Roadster in 2008. How much do you think the "car was well into development"? (Elon had joined to company in February 2004, purchased majority share of the whole company and first prototype of Roadster was revealed on July 19, 2006.) Martin Eberhard probably had a prototype inverter and maybe a prototype motor before Elon joined Tesla but I wouldn't call that "well into the development".
