VAG has been doing over 20 years tricks where they comply with the law and all the data is accessible through ODB II port but the protocol is secret and officially the only tool that can access the data is manufacturer's own diagnostic tool. This is no different from Apple using parts with embedded serial codes and changing the motherboard to allow new replacement part requires proprieatry tool.
