  1. 5/4 or 8/5 this all feels wrong. Judges should never be Republican or Democrats they should be independant.

  2. This will be an intresting Supreme Court Case. The Federal Judicary Act of 1869 defines that the Supreme Court shall consist of 1 + 8 justices. However this is an Act and acts can be ammended. Republicans will have a hard time proving before the Supreme Court it's unconstitutional since the Constitution is not mentioning any of it. And the Supreme Court will have to judge over a decission over themselves. If the judges screw this up and allow it to be partisan all hell can break lose. The hole institution can self-invalidate maybe even self-destruct if they screw this thing up. It can lead to a constitutional crisis of epic proportions and may even lead to create a new institution which replaces the Supreme Court. P.S.   3. Actually it would be intresting to see who is voting against this well at least the democrats we all know how Republicans will vote, they never let go of an advantage.
