Aaron Reichert I'm trying to understand if you even sophisticated enough to back your propositions. Because when it comes to minarchist arguments, I normally find them to be lacking insofar as their rejection of the social contract goes, they end up in contradiction in that they use a social contract model. That model is the Non-aggression doctrine. Not to mention that in that same doctrine, it requires the state to enforce it. Now let's put marriage in the form of the non-aggression doctrine since it is a social contract, if one member of the married persons started to treat a partner with abuse, either battery or rape, and the abused retaliates to the abuser, and decides to take the case to court, then I do not see how you would want the state to deal with this.
I thought that in minarchism, the state is the means of upholding human rights, so is it not a human right to not have an abusive marriage?
