  10. Assuming that he was the only authorized driver, Hertz can challenge this claim, but they would need to prove that was the case, which wouldn’t be easy to do. Maybe subpoena his credit card records and show that he couldn’t have been the driver based on time and location of his transactions? Of course, he would probably be very aware of this and not leave any kind of electronic record.
