This American soldier entered North Korea illegally and that is a crime in every nation... well, maybe not the US today... and placing this person in prison would not be considered an act of war. If he is mistreated in prison, that would be a different story... but still not an act of war. I wouldn't risk the lives of more American soldiers to rescue one that entered North Korea on his own. To some degree... he's getting what he deserves.
