  1. Question: do deposits count as regulatory capital in the US under current Federal Reserve regulations? According to what I've read in the Federal Register, Tier 1 regulatory capital includes bank equity (explicitly common equity and in some instances preferred) and instruments subordinated to subordinated debt. Tier 2 includes bank reserves and deposits held at Federal Reserve Banks. The question is whether or not deposits in commercial banks count as instruments subordinated to subordinated debt.
