Do you think they have read section 1.3 of the 14th Amendment, requiring due process?

Technically and legally, he was taken off the ballot until he filed the SCOTUS appeal. But only a few sources properly titled the story by including "pending SCOTUS appeal". Now most people are going to be lost and confused as to why he's back on the ballot.

@Vercingetorix504 No, judges did not do that. State and Federal prosecutors did that. Prosecutors appointed from Trump's opposing party. Technically, the federal prosecution stems from Biden, given that the Attorney General is a cabinet position and serves at the behest of the President.

@Vercingetorix504 He does have 91 indictments. And indictments come from prosecutors, not judges. Do you need a civics class?

@Vercingetorix504 Yup. A grand jury, not a criminal jury. Meaning it only takes a majority decision rather than a unanimous one. It's easy to get a majority in blue court districts, given that jurors are selected from voter registrations. You clearly still need that civics class.

@Vercingetorix504 Fanni Willis is the prosecutor in the case in Georgia. She is the District Attorney for Fulton County and a member of the Democrat Party. Biden won Fulton County with 76% of the vote. I'm not suggesting anything, these are just the facts.

@mooseheadjack1 How do we determine a candidates age? Is it just based on public opinion? Or do we have a legal way to prove age, such as a birth certificate? How do we prove criminal guilt in this country? Is it a unanimous decision by a jury of your peers in a criminal courtroom? Do we have this proof of guilt?

@mooseheadjack1 Insurrection, by all definitions, is an infamous crime. What does the first sentence of the fifth amendment say about answering for an infamous crime? Trump is a moron, but this is not a legal precedent we want. A judge should not be able to decide this. Juries are an important part of our legal process for a reason.

@danevertt3210 He has not been "charged an insurrectionist" in any state. The only rulings that have occurred are in a civil court. That is not the due process clearly stated in the first sentence of the fifth amendment. The due process that is required by Section 1.3 of the 14th Amendment. Stop spreading misinformation.

@Tyrell_Corp2019 Section 1.3 of the 14th Amendment requires due process, given that holding office is a privilege of citizenship. Due process for these types of allegations is clearly stated in the first sentence of the fifth amendment.
